πŸ“‹ What You Need to Know (Plain English)

  • β€’ Ownerfi shows two kinds of properties:
    • – Owner-finance candidates: listings where the seller may consider owner financing. We do not know whether the seller will actually accept owner financing, and we make no promise that they will. You or your agent must ask the seller directly.
    • – Cash deals: properties priced below market estimates, intended for investors looking to buy with cash. These are not for retail buyers seeking owner financing.
  • β€’ We share your contact info with licensed real estate agents who will call/text/email you to offer help
  • β€’ Agents pay Ownerfi a referral fee (30% of their commission) when they help you close on a home
  • β€’ Agents will offer to show properties, write offers, and represent you (optional)
  • β€’ You can decline representation anytime by telling the agent "I do not want representation"
  • β€’ Ownerfi is NOT your agent or broker β€” we don't represent buyers or sellers
  • β€’ We do NOT verify property information β€” listings may be inaccurate, outdated, or unavailable
  • β€’ Payment estimates are illustrations only β€” not quotes or commitments
  • β€’ You must verify everything yourself with licensed professionals
  • β€’ We are not responsible for agent behavior after you decline representation

1. What Ownerfi Does

Ownerfi is a property search and lead-generation platform for owner-finance–friendly real estate.

We:

  • Collect publicly available listing data
  • Display two distinct categories of properties:
    • Owner-finance candidates β€” listings where signals in the public data suggest the seller may be open to owner financing. We have not contacted the seller and have no confirmation that owner financing will actually be offered. The seller may decline owner financing for any reason or no reason.
    • Cash deals β€” listings priced below independent market estimates (Zestimate / ARV), surfaced for investors looking to purchase with cash. The cash-deal section is not intended for buyers seeking owner financing.
  • Allow users to sign up and express interest in properties
  • Share user contact information with licensed real estate agents ("Partner Agents") in the user's local market
  • Allow Partner Agents to contact the user to offer:
    • Showing appointments
    • Writing offers
    • Buyer representation
    • Owner-finance guidance
    • Transaction assistance

1A. Owner-Finance Candidates, Cash Deals, and Distressed Listings β€” What These Tags Mean

⚠️ Read Before You Tour, Travel, or Sign Anything

  • "Owner Finance" / Owner-Finance Candidate means our automated systems detected language or signals in the public listing that the seller may consider owner financing. We have not contacted the seller. Owner financing is not guaranteed, may have terms wildly different from any payment estimate shown, and the seller may decline owner financing for any reason or no reason. Always confirm directly with the seller's listing agent before incurring any cost (travel, inspection, attorney, application fees).
  • "Cash Deal" listings are surfaced for investors purchasing with cash based on price-to-Zestimate ratio. Owner financing is generally NOT available on these. Retail buyers seeking owner financing should look only at Owner Finance listings.
  • "Auction" / "Foreclosure" / "Bank Owned" / "Pre-Foreclosure" listings display a price prefixed with "Est." β€” that price is an opening bid, foreclosure filing amount, or bank estimate, NOT a seller's asking price. Final sale price typically differs significantly. These listings frequently come with title issues, occupancy issues (someone living there), sold-as-is condition, and additional fees. Use the "Hide Auctions"filter on the dashboard to exclude them. Engage an attorney before bidding.
  • "Land" / vacant lots appear unless you toggle "Hide Land". Verify the property type before viewing.

You agree that costs you incur in reliance on these tags β€” including travel, inspections, appraisals, attorney fees, application fees, and earnest money β€” are your own responsibility. Ownerfi is not liable for any such costs whether or not the listing turns out to be available, accurate, or suitable.

Mortgage Licensing & Servicemember Notes

  • Seller licensing (Dodd-Frank / SAFE Act): Owner financing offered by a non-institutional seller may, in some states and depending on volume, require the seller to be a licensed Mortgage Loan Originator. This is the seller's obligation, not Ownerfi's and not the buyer's, but it can affect the enforceability and terms of any seller-financed loan. Buyers and sellers should consult an attorney before structuring an owner-finance transaction.
  • Active-duty servicemembers: The Servicemembers Civil Relief Act (SCRA) provides interest-rate caps, foreclosure protections, and other rights for active-duty members of the US Armed Forces. If you are a servicemember, raise SCRA protections with your closing attorney before signing any owner-finance note.

2. Ownerfi Is NOT Your Agent

Ownerfi:

  • Is not a real estate brokerage
  • Does not represent buyers or sellers
  • Does not provide legal, financial, or loan advice
  • Does not negotiate offers
  • Does not participate in transactions
  • Does not receive a commission on real estate transactions

All representation services come from licensed real estate agents, not from Ownerfi.

Fee Clarification

We do not receive a commission on real estate transactions. Any fees paid to us are fees for advertising and lead-generation services, not real estate brokerage commissions.

3. User Contact Information Is Shared With Real Estate Agents

By submitting your information on Ownerfi, you authorize us to share your profile (name, phone, email, property interest, budget, and relevant details) with licensed real estate agents in your general area.

These agents may contact you via:

  • call
  • text
  • email

Their goal is to help you:

  • schedule showings
  • make offers
  • understand owner-finance options
  • navigate the purchase process

πŸ“± Express Consent to Contact (TCPA / Do-Not-Call)

By submitting your phone number, email address, or other contact information to Ownerfi, you expressly consent to receive calls, text messages, and emails from Ownerfi and from Partner Agents we share your information with, including:

  • calls and SMS placed using automatic dialing systems or pre-recorded / artificial voice messages
  • contact even if your number is on a federal or state Do-Not-Call list
  • contact at the number(s) you provide, including mobile numbers (standard message and data rates may apply)

Consent is not a condition of purchasing any goods or services. You may revoke consent at any time by:

  • Replying STOP to any text message
  • Telling the agent on a call or in writing to stop contacting you
  • Emailing support@ownerfi.ai with "REVOKE CONSENT" in the subject line

4. Users May Decline Representation

βœ… You Have a Choice

If you prefer not to be represented:

  • You may tell any agent who contacts you: "I do not wish to be represented."
  • It is the agent's responsibility to stop contacting you once notified.
  • Ownerfi is not responsible for ongoing communication from agents after you decline representation.

5. Agent Behavior

Partner Agents must follow:

  • federal and state real estate laws
  • consumer protection requirements
  • Do-Not-Call rules (once you ask them to stop)

⚠️ Ownerfi Is Not Responsible For:

  • agent conduct
  • agent communication frequency
  • advice provided by agents
  • negotiation outcomes

🏠 Fair Housing Complaints

Partner Agents must comply with the federal Fair Housing Act and your state's fair-housing laws. It is illegal for an agent to refuse service, treat you differently, or steer you based on race, color, national origin, religion, sex (including gender identity and sexual orientation), familial status, disability, or any other protected class.

If you believe an agent has discriminated against you:

  • File a complaint with HUD: 1-800-669-9777 (TTY 1-800-927-9275) or online at hud.gov/fairhousing
  • Contact your state fair-housing or real estate commission
  • Report the agent to Ownerfi at support@ownerfi.ai with "FAIR HOUSING" in the subject line β€” we may review reports and, in our discretion, suspend or remove an agent's account

πŸ“£ Report Agent Abuse or Harassment

If a Partner Agent contacts you after you've asked them to stop, behaves unprofessionally, makes deceptive statements about a property, or pressures you, email support@ownerfi.ai with "AGENT REPORT" in the subject line. Include the agent's name and the date(s) of contact. Ownerfi may, in our discretion, review reports and suspend or remove agents found in violation of these Terms; however, Ownerfi makes no guarantee of any particular response, timeframe, or outcome.

6. Property Information Disclaimer

Ownerfi relies on public data sources, MLS feeds, and automated systems.

Therefore:

  • We do not verify any property details
  • Information may be inaccurate, outdated, or incomplete
  • Owner-finance terms may change without notice
  • Listings may be sold, withdrawn, or unavailable

You MUST independently verify all property information with licensed professionals.

7. No Guarantees or Approvals

Ownerfi does not:

  • approve buyers
  • prequalify buyers
  • guarantee financing
  • guarantee that any seller will accept owner financing β€” properties are surfaced as candidates based on public-data signals, not seller commitments
  • promise any property is still available
  • represent that cash-deal listings are suitable for retail (non-investor) buyers

8. User Responsibilities

You agree to:

  • verify all property details independently
  • communicate directly with agents for showings and offers
  • notify agents if you do not want representation
  • verify owner-finance terms directly with sellers or their agents

Independent Verification Required

You agree not to make any purchase or financing decision based solely on information from our platform without independent verification from licensed professionals (real estate agents, attorneys, financial advisors, home inspectors, etc.).

9. Payment Estimates Disclaimer

Any payment calculations shown on Ownerfi are illustrative estimates only and may differ substantially from actual seller terms.

They are NOT commitments or quotes.

10. Limitation of Liability

⚠️ Liability Limitation

Ownerfi is not liable for:

  • inaccurate data
  • communication from agents
  • decisions made based on Ownerfi's displays
  • losses, disputes, failed offers, or denied approvals
  • any earnest money deposit, escrow funds, financing failure, contract breach, title defects, inspection findings, repair costs, or closing-related dispute
  • any cost you incur before, during, or after attempting to purchase a property, including travel, lodging, attorney fees, inspection fees, application fees, or appraisal fees
  • actions or inactions of any Partner Agent, seller, lender, escrow agent, title company, attorney, or third-party service provider

Your sole remedy is to stop using the Service.

To the maximum extent permitted by law, Ownerfi's total aggregate liability for any claim arising out of or related to the Service or these Terms is limited to the greater of (a) the total fees you paid Ownerfi in the twelve months preceding the claim, or (b) US$500. This cap does not apply to (i) Ownerfi's gross negligence or willful misconduct, or (ii) claims that cannot be limited by contract under applicable law (such as certain TCPA, Fair Housing Act, or state consumer-protection statutory claims).

10A. Transactions, Deposits, and Closing Risk

Ownerfi has no role in any purchase contract, earnest money deposit, escrow, financing, title work, inspection, appraisal, or closing. We do not hold, transfer, or insure any funds.

Real estate transactions involve significant financial risk. Owner-finance terms (down payment, interest rate, balloon, default remedies) should be reviewed by a licensed attorney before you sign anything. Auctions and foreclosures carry additional risks including title defects, occupancy disputes, and as-is condition. Cash deals from distressed sellers can involve fraud β€” verify every counterparty independently.

⚠️ Wire fraud warning: Ownerfi never sends, receives, or instructs the wiring of funds. If you receive wire instructions claiming to be from Ownerfi, or if closing wire instructions arrive by email near a closing date, treat them as potentially fraudulent. Always verify wire instructions by phone using a number you independently obtained from the title company or escrow agent β€” never use a number contained in the email itself.

11. Refund Policy

All payments made to Ownerfi (if any) are non-refundable, except where prohibited by law or where we fail to provide the agreed-upon service.

If you believe you are entitled to a refund due to service failure or applicable law, contact support@ownerfi.ai.

12. Dispute Resolution & Arbitration

Any disputes arising from these Terms or your use of our Service are resolved by binding arbitration, not in court, except as provided below.

Governing Law: These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.

Class Action Waiver

You waive any right to participate in a class action, class arbitration, or other representative action. All disputes must be brought in your individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.

Opt-Out Right

You may opt out of this arbitration agreement by sending written notice to support@ownerfi.ai within 30 days of first accepting these Terms. Your notice must include your name, address, email, and a clear statement that you wish to opt out of arbitration.

Small Claims Exception

Either party may bring qualifying claims in small claims court in the county of your residence or in Nashville, Tennessee, if the claims fall within that court's jurisdiction.

Arbitration Administrator & Fees

Arbitration is conducted by the American Arbitration Association (AAA)under its Consumer Arbitration Rules (available at adr.org), or, if AAA is unavailable, by another mutually agreed administrator.

Consistent with AAA Consumer Rules, for any consumer claim Ownerfi will pay all arbitration filing, administrative, and arbitrator fees that exceed the equivalent filing fee in your local state court (typically all fees over US$200). You remain responsible for your own attorney's fees unless a statute or the arbitrator awards them. The arbitration may be conducted in person, by phone, by video, or on documents only, at your election where the AAA rules permit.

13. Changes to Terms

We may modify these Terms at any time. Continued use constitutes acceptance.

13A. Accessibility

Ownerfi strives to make our website usable by people with disabilities and aims to conform to WCAG 2.1 Level AA guidelines where reasonably feasible. We test with screen readers and keyboard navigation and address accessibility issues on an ongoing basis.

If you encounter an accessibility barrier on our site, or need information presented in an alternative format, please email support@ownerfi.ai with "ACCESSIBILITY" in the subject line. We'll work in good faith to address the issue or provide the requested information through an alternative channel.

14. General Terms

Force Majeure. Ownerfi is not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, internet or hosting outages, third-party API failures (data providers, payment processors, SMS/email carriers), governmental action, or labor disputes.

Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.

Survival. Sections covering Limitation of Liability, Indemnification, Dispute Resolution, Class Action Waiver, Refund Policy, and these General Terms survive termination or expiration of these Terms.

No Assignment. You may not assign these Terms or your account to anyone else without our written consent. Ownerfi may assign these Terms to an affiliate, acquirer, or successor.

Entire Agreement. These Terms, together with our Privacy Policy and any referral agreements you sign, constitute the entire agreement between you and Ownerfi and supersede any prior understanding.

Service Outside the United States. The Service is offered to users in the United States. We do not target, market, or knowingly accept users in the European Economic Area, United Kingdom, or other jurisdictions with comprehensive personal-data laws (such as GDPR). If you access the Service from outside the U.S., you do so at your own risk and agree that U.S. law governs.

βœ… By Using Ownerfi, You Agree

By using Ownerfi, you acknowledge that you have read and agree to these Terms of Service. You understand that: (1) your contact information will be shared with licensed real estate agents who may contact you; (2) agents pay Ownerfi a referral fee when you close; (3) you can decline representation at any time; (4) Ownerfi does not verify property information; (5) all data may be inaccurate or outdated; (6) you must independently verify all information with licensed professionals; (7) you give express written consent to receive auto-dialed/pre-recorded calls and SMS from Ownerfi and Partner Agents per Section 3, even if your number is on a Do-Not-Call list, and you may revoke that consent at any time; (8) Owner-finance, cash-deal, and auction tags are descriptive, not commitments β€” sellers may decline owner financing, cash deals are for investors, and auction prices are estimates; (9) you are solely responsible for all costs you incur in reliance on listings (travel, inspections, attorney fees, deposits); and (10) Ownerfi's total liability to you is limited as described in Section 10.
